This U.S. State Privacy Notice supplements the Mattress Overstock Privacy Policy. It applies only when a state privacy law covers Mattress Overstock and the person making the request. Rights and definitions vary by state.
Information covered by this notice
We may process these categories of personal information as described in the Privacy Policy:
- Identifiers and contact information.
- Customer-record information, such as address, telephone number, and transaction details.
- Commercial information, such as products viewed, considered, purchased, exchanged, or saved.
- Internet or other electronic network activity.
- Approximate geolocation derived from IP address or device context.
- Audio or communication information when you call, text, email, or chat with us.
- Professional information when you choose to provide it in a business or service request.
- Inferences about product preferences, comfort, budget, interests, and purchase timing.
- Account credentials and payment information processed by Shopify and payment providers.
We collect this information from you, your browser or device, Shopify, payment and fulfillment providers, advertising and analytics platforms, call and messaging providers, and our staff. We use it for commerce, customer service, recommendations, security, analytics, advertising, attribution, recordkeeping, and legal compliance.
Sale, sharing, and targeted advertising
We do not sell personal information for money. We use advertising and analytics services. Depending on state law, disclosure of identifiers, commercial information, website activity, approximate location, or inferences to advertising partners may be treated as sale, sharing, or targeted advertising.
Recipient categories can include advertising networks and platforms, analytics providers, Shopify and Shopify Enhanced Services, and providers that support measurement or attribution.
Our Shopify data-sharing opt-out page is configured for the U.S. states where our current Shopify Customer Privacy policy marks the browser-based opt-out as required. In those configured states, use Your Privacy Choices to opt out for the current browser or device and, if you choose, an associated customer account. A recognized Global Privacy Control signal is treated as an opt-out in those configured regions.
As of August 25, 2026, the configured states are California, Colorado, Connecticut, Delaware, Florida, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia. We can update this list when our obligations or Shopify settings change.
Outside those configured regions, the browser form can state that it is not applicable. Shopify, Meta, Google, or another provider can still apply its own privacy control when it receives a browser privacy signal. You may contact us for review of any right that might apply even when the browser form is unavailable.
California residents
If the California Consumer Privacy Act applies, a California resident may have rights to know, access, correct, delete, and receive information; opt out of sale or sharing; limit certain uses of sensitive personal information; and receive equal service after exercising a right, subject to legal exceptions.
During the previous 12 months, we may have collected and disclosed for a business purpose the categories listed above. We may have shared identifiers, commercial information, Internet or network activity, approximate geolocation, and inferences with advertising or analytics partners for cross-context behavioral advertising. We do not knowingly sell or share personal information of people under 16.
Kentucky residents
If the Kentucky Consumer Data Protection Act applies, a Kentucky resident may have rights to confirm processing and access personal data, correct inaccuracies, delete personal data, obtain a portable copy, and opt out of targeted advertising, sale of personal data, or certain profiling, subject to legal exceptions.
Our current Shopify regional settings do not activate the automatic browser opt-out form based only on a Kentucky location. A Kentucky resident can still submit a privacy request using the contact methods below, and we will evaluate the request under the law that applies to the requester and our business.
Residents of other U.S. states
Residents of other states may have similar rights when the applicable state law covers Mattress Overstock. We will evaluate a request under the law that applies to the requester and our business.
Submit a request
- Sale, sharing, or targeted-advertising opt-out: use Your Privacy Choices where available. If the page says the browser option is not applicable, email us with the subject "Privacy Request."
- Access, correction, deletion, portability, or another privacy request: email help@mattressoverstock.email with the subject "Privacy Request" or call (859) 710-9265.
- Appeal: email help@mattressoverstock.email with the subject "Privacy Appeal" and identify the request you want reviewed.
We may ask for information needed to verify your identity, residence, account, or authority. We do not require you to create a new account to submit a request. An authorized agent may submit a request where permitted by law. We will respond within the period required by the applicable law and explain any denial and available appeal or complaint path.
